Mediation Services
Why chose mediation?
Mediation is a form of Alternate Dispute Resolution (ADR). Unlike other forms of dispute resolution such as going to court (litigation) or using an Arbitrator, Mediation allows the parties to control outcomes. In the courtroom there are clear winners and losers, and decisions are imposed by a judge after hearing testimony. This lacks creativity and does not allow for input from the people involved. With Mediation, we work on the relationship- and allowing the interests (Needs, Desires, Fears, Concerns) of the disputants to come out organically and help to formulate an agreement based on solutions that are built in the room by the parties involved with assistance from the Mediator.
Mediation is much quicker than the court process, and much less expensive. The party’s in dispute have total control over outcomes. It is a voluntary process, and is accessible at any time even if a legal proceeding has been initiated.
How does mediation work?
Collective Solutions offers Mediation Services to a variety of clients-anyone who requires assistance in settling a dispute can benefit from mediation.
Some areas include:
• Employment disputes
• Small claims
• Workplace dismissals
• Neighborhood disputes
• Rental/purchase disputes
• Property disagreements
• Contract disputes
What is the process?
Each party must agree to mediate the dispute. Once each party has made contact with Collective Solutions and completed a short outline of the dispute and answered a few questions, we will be in touch to complete an initial intake session with each party. At the conclusion of these confidential sessions (each party will meet with the mediator privately to discuss the matter), each party will sign a contract to mediate and a mutually agreeable date for the mediation will be established. Party’s should attend the intake with some ideas of what they are hoping to achieve, and some dates in mind to convene for the mediation.
Collective Solutions Mediation begins with a goal of coming to a meaningful, win-win solution. Unlike litigation, mediation takes the parties interests into consideration and allows the parties to come to a solution on their terms. A decision will not be imposed like it will be in the courtroom- with Collective Solutions the parties maintain control over outcomes and agreements and we won’t stop until all of the issues have been identified and addressed.
Shuttle Mediation
If there are concerns with meeting with all of the parties involved- we can use Shuttle Mediation- where the parties are in separate rooms and the Mediator works between the parties separately, taking away any of the stress or concerns of meeting with the other parties to the dispute.
